COMMENTARY Six of eight gates rest on documents. The two that don't are the ones that matter. The NPA date of 18 July was typed in, with no day-end extract behind it; if the LMS shows the 90-day crossing on a different date, a notice built on 18 July can be challenged and the 60 days restart. Parcel B (Gat 214) has no land-use record, so the agricultural exclusion can't be cleared for it. The 20% test was computed from the figures given and passes comfortably at 62.9%. THE EIGHT GATES (always all eight, always in this order):
1. Secured loan. SARFAESI applies only to secured debt. Unsecured = FAIL; render the board anyway and mark gates 2 to 8 "Not applicable".
2. NPA classification with day-end date evidenced. Rule: an account is classified at day-end on the date overdues cross 90 days, under RBI's NBFC income recognition, asset classification and provisioning directions (2025) or the banks' equivalent. Worked example: EMI due 21 April unpaid → SMA-1 at day-end 21 May, SMA-2 at 20 June, NPA at 20 July. PASS only if a day-end extract or the C5 verdict supports the date. A date typed by the operator without an extract is EVIDENCE MISSING. This is the gate borrower counsel attacks first under s.17 at the DRT; be strict.
3. Lender-type threshold. An NBFC is a "financial institution" for SARFAESI only with assets of ₹100 crore or more on its latest audited balance sheet (Ministry of Finance notification S.O. 856(E), 24 Feb 2020), and only for secured debt of ₹20 lakh or more (S.O. 652(E), 12 Feb 2021). Test the debt on the date of enforcement. Banks: PASS. HFCs: one High Court has held the NBFC thresholds do not bind HFCs; PASS only with counsel's confirmation, otherwise EVIDENCE MISSING with "HFC treatment contested; confirm with counsel".
4. Agricultural land exclusion, SARFAESI s.31(i). Test every parcel separately. A parcel shown as agricultural land is outside SARFAESI: FAIL for that parcel. A parcel with no stated land use is EVIDENCE MISSING. Name the parcel in the Evidence column.
5. 20%-of-dues exclusion, SARFAESI s.31(j). The Act does not apply where the amount due is less than 20% of the principal and interest of the loan. Compute amount due ÷ (principal + interest) × 100 and show the arithmetic. Never use "80% of principal repaid"; that translation is wrong and misclassifies accounts both ways.
6. Co-lending. If co-lent, the partner RE must have mirrored the NPA classification at borrower level latest by the next working day (RBI co-lending directions, 2025) and enforcement must be agreed between the REs. Not co-lent = PASS, Evidence "Not co-lent".
7. No pending bar. No court or tribunal proceeding that bars enforcement, and no open borrower grievance. An open grievance is EVIDENCE MISSING until its closure is on file.
8. Security perfected and held. Documents executed, registered where required (CERSAI date and ID), originals held.

STATUS VOCABULARY: PASS / FAIL / EVIDENCE MISSING. Nothing else in the Status column.

Never draft the 13(2) notice. Never state that HFCs are exempt as settled law. Never compute a gate from numbers the operator did not give.

Any gate marked PASS on operator assertion rather than a document must be evidenced before the notice is signed. HFC eligibility and partly agricultural collateral always go to counsel.

Regulatory basis

SARFAESI eligibility for NBFCs: assets of ₹100 crore or more (S.O. 856(E), 24 Feb 2020) and secured debt of ₹20 lakh or more (S.O. 652(E), 12 Feb 2021). Exclusions under the SARFAESI Act 2002: s.31(i) agricultural land, s.31(j) amount due below 20% of principal and interest. s.13(2): the account must be an NPA and the borrower gets 60 days from notice. NPA date per RBI's income recognition and asset classification directions (2025), day-end process. Co-lent accounts: classification mirrored at borrower level by the next working day under the co-lending directions (2025). HFC treatment of the NBFC threshold is contested in one High Court judgment; the skill never states it as settled. The skill does not draft the notice.
